Terms and Conditions
These Terms & Conditions apply to all estimates, quotations, work orders, services, repairs, maintenance, installations, storage, and products supplied by Watertight Boatworks Inc. (“Watertight Boatworks”, “we”, “our”, or “us”).
By approving an estimate, requesting services, delivering a vessel for work, or purchasing products from Watertight Boatworks, the customer (“Owner”, “Customer”, or “Client”) agrees to these Terms & Conditions.
Estimates & Quotations
All estimates and quotations are provided in good faith based on the information available at the time.
Marine repairs often involve concealed damage that may not be visible until work has commenced. Should additional repairs, labour, materials, or services be required, Watertight Boatworks will notify the customer and provide an updated estimate where practical.
Estimates are valid for 30 days unless otherwise stated.
Authorization to Proceed
Approval of an estimate, work order, email authorization, signed agreement, or verbal authorization constitutes permission for Watertight Boatworks to proceed with the work described.
Additional work requested during the project may be billed separately.
Payment Terms
Unless otherwise agreed in writing:
- Deposits may be required prior to commencement of work.
- Invoices are due upon receipt.
- Final payment must be received before vessel release unless otherwise agreed.
- Products ordered specifically for a customer may require full payment in advance.
Watertight Boatworks reserves the right to suspend work on overdue accounts.
Late Payments
Invoices not paid within 30 days may be subject to interest charges of 2% per month (24% annually) on overdue balances.
The customer is responsible for all reasonable costs incurred in the collection of outstanding accounts, including legal fees and collection costs.
Vessel Storage & Yard Fees
Vessels remaining at our facility after completion of work may be subject to storage fees. Storage charges may also apply where:
- Work is delayed due to customer decisions.
- Parts are unavailable.
- Payment remains outstanding.
- The vessel is not collected within a reasonable period.
Storage rates will be communicated upon request.
Haul-Out, Launch & Third-Party Services
Watertight Boatworks may coordinate haul-outs, launches, transportation, crane services, marina services, or subcontractors on behalf of the customer.
Third-party charges are the responsibility of the customer and may be invoiced separately.
While we work with reputable providers, Watertight Boatworks is not responsible for delays, pricing changes, or issues arising from third-party services.
Fiberglass, Paint & Cosmetic Repairs
Colour matching of gelcoat and paint is performed using industry-standard methods and professional judgement. While every effort is made to achieve a seamless repair, exact colour matches cannot be guaranteed due to:
- Weathering
- UV exposure
- Previous repairs
- Product availability
- Age of vessel
Hidden Damage
Marine repair work frequently reveals hidden structural, mechanical, or cosmetic issues. The customer acknowledges that; additional repairs may be required once work begins, original estimates may need adjustment, and project timelines may change as a result. Watertight Boatworks will communicate significant discoveries as soon as reasonably possible.
The Owner acknowledges that marine repair and restoration work is investigative in nature. Upon discovery of hidden damage, deterioration, water intrusion, structural deficiencies, previous improper repairs, or unsafe conditions, Watertight Boatworks is authorized to take reasonable steps necessary to prevent further damage to the vessel until the Owner can be consulted.
Product Sales & Installations
Products supplied by Watertight Boatworks may be covered by manufacturer warranties. Manufacturer warranties remain subject to the terms and conditions of the respective manufacturer. Watertight Boatworks does not provide warranties beyond those expressly stated in writing.
Shipping & Delivery
Watertight Boatworks ships products throughout Canada and internationally where available. Shipping and delivery dates are estimates only and are not guaranteed. Watertight Boatworks shall not be liable for delays caused by:
- Carriers or freight providers
- Customs clearance
- Weather events
- Port disruptions
- Supply chain interruptions
- Manufacturer delays
- Circumstances beyond our reasonable control
Risk of loss and ownership of products passes to the Customer upon delivery to the carrier or upon collection by the Customer.
Customers are responsible for inspecting shipments upon receipt and must report any visible shipping damage within 48 hours of delivery. Claims relating to shipping damage may require supporting photographs and original packaging materials.
Shipping costs, duties, taxes, brokerage fees, customs charges, and import fees are the responsibility of the Customer unless otherwise stated in writing.
Special Order Products
Certain products supplied by Watertight Boatworks may be special-order or custom-order items.
Special-order products may require a deposit or full payment prior to ordering and may not be eligible for cancellation, return, or refund once the order has been placed with the manufacturer or supplier.
Estimated lead times are provided for guidance only and may be subject to change without notice.
Returns & Refunds
Returns may be accepted at the sole discretion of Watertight Boatworks and may be subject to restocking fees.
The following items are generally not eligible for return:
- Special-order products
- Custom-manufactured products
- Installed products
- Electrical components
- Products showing signs of use or installation
Customers must obtain authorization prior to returning any product.
Product Availability
Product pricing, specifications, availability, and lead times are subject to change without notice.
Watertight Boatworks reserves the right to substitute equivalent products where necessary or cancel orders due to manufacturer discontinuation, pricing errors, or supply constraints.
Customer Property
Customers are responsible for removing valuables, electronics, personal belongings, cash, and sensitive items from their vessel prior to work commencing. Watertight Boatworks shall not be liable for loss of personal property left aboard the vessel.
Limitation of Liability
To the fullest extent permitted by law, Watertight Boatworks shall not be liable for:
- Loss of use of vessel
- Loss of revenue
- Loss of charter income
- Travel expenses
- Consequential damages
- Indirect damages
- Delays caused by weather, suppliers, subcontractors, shipping, or circumstances beyond our control
Our liability for any claim shall be limited to the value of the services performed by Watertight Boatworks.
Delays & Force Majeure
Project schedules are estimates only. Watertight Boatworks shall not be responsible for delays caused by:
- Weather conditions
- Material shortages
- Supplier delays
- Labour shortages
- Government actions
- Marina scheduling
- Transportation issues
- Circumstances beyond our reasonable control
Abandoned Vessels
Any vessel left in our care for an unreasonable period after completion of work, despite reasonable efforts to contact the owner, may be subject to storage charges and remedies available under applicable British Columbia laws relating to unpaid accounts and abandoned property.
Photographs & Marketing
Watertight Boatworks may photograph vessels before, during, and after work for quality control, documentation, training, insurance, and marketing purposes. Customer names, registration numbers, and personal information will not be disclosed without permission. If you do not wish your vessel to appear in marketing materials, please notify us in writing prior to commencement of work.
Warranty
Watertight Boatworks warrants its workmanship for a period of 12 months from the date of completion, unless otherwise specified in writing.
This warranty does not cover:
- Normal wear and tear
- Improper use
- Groundings or collisions
- Lack of maintenance
- Damage caused by third parties
- Manufacturer defects
- Environmental exposure
Warranty claims must be submitted in writing.
Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.
Marketing Communications
By requesting information, submitting a contact form, requesting a quotation, purchasing products or services, or otherwise providing contact information to Watertight Boatworks, the Customer agrees that Watertight Boatworks may contact them regarding:
- Service reminders and maintenance recommendations
- Special offers and promotions
- New products and services
- Company news and updates
- Educational and informational content related to boating and vessel maintenance
Customers may withdraw their consent and unsubscribe from marketing communications at any time by using the unsubscribe link included in electronic communications or by contacting Watertight Boatworks directly.
Watertight Boatworks will not sell, rent, or share customer information with third parties for marketing purposes without consent, except where required by law.
